Droit de suite

Droit de suite, or the artist’s resale right, entitles an artist to a royalty when an original work of theirs is resold with an art market professional involved, such as an auction house, gallery or dealer. In the European Union it follows from Directive 2001/84/EC and lasts for the artist’s life and 70 years after their death. After the artist dies, the right belongs to their heirs. The royalty is a sliding percentage of the sale price, capped at €12,500 per sale, and each member state sets a minimum price below which it does not apply. Sales between private individuals are outside its scope.
